Overview

In this assignment, you will examine the legal and ethical challenges associated with intelligence surveillance programs. Intelligence agencies often rely on surveillance capabilities to identify threats, collect information, and support national security objectives. At the same time, these programs frequently raise concerns regarding privacy, government power, transparency, and civil liberties.

You will analyze a specific surveillance program, evaluate the legal authorities and limitations that govern its operation, and assess the ethical questions that emerge when intelligence collection affects individual rights. You will also consider how oversight mechanisms can strengthen public trust while preserving national security capabilities.

Assignment Topic

Select a surveillance program and provide a detailed analysis of its purpose, operation, and impact. Examples may include PRISM, the NSA telephone metadata program, FISA-authorized surveillance activities, ECHELON, or another instructor-approved intelligence collection program.

Begin by explaining the program’s origins, objectives, and operational methods. Discuss the intelligence or national security goals the program was designed to achieve and describe how information was collected, stored, analyzed, or shared.

Next, examine the legal implications of the program. Identify and discuss the laws, court decisions, executive authorities, congressional actions, or regulatory frameworks that authorized, restricted, or challenged the program. Evaluate whether the program operated within established legal boundaries and explain any controversies surrounding its legality.

Then analyze the ethical implications of the program. Consider issues such as privacy rights, government transparency, informed consent, data collection practices, public trust, civil liberties, and the balance between national security and individual freedoms.

Finally, develop recommendations for improving oversight, accountability, and public confidence in intelligence operations. Consider the roles of congressional oversight, judicial review, internal agency controls, independent audits, transparency measures, and other accountability mechanisms.

Conclude by evaluating whether the benefits of the program justified its costs and whether additional safeguards should be implemented in future intelligence collection efforts.
