Overview

Conspiracy is a distinct criminal offense that focuses on agreement and intent rather than the successful completion of a crime. Prosecutors must show that a defendant knowingly entered into an agreement to commit a criminal act and, in most jurisdictions, that at least one overt act was taken in furtherance of that agreement. These cases often raise challenging questions about inference, association, and whether conduct alone is enough to establish criminal agreement.

In this activity, you will analyze a hypothetical scenario involving alleged bribery and conspiracy within an organized crime context. You will determine whether the facts support a charge of conspiracy by examining agreement, intent, and overt acts. This exercise emphasizes careful legal reasoning and helps clarify the limits of conspiracy liability when direct communication or explicit agreement may be absent.

Discussion Topic(s)
Answer the below questions, with the Learning Activity Topic (LAT) The Lapomardo, an Italian Mafia “family” in Worcester, are involved in a number of criminal enterprises. As part of tradition, it is generally understood that all relatives have an obligation to help the “family” whenever possible. Michael is the 18-year-old nephew of the Mafia boss. He has never discussed any illegal activity directly with his uncle or any other member of the family. One evening, however, a family member is arrested for dealing cocaine. In response, Michael bribes the arresting officer to release his relative and dispose of the evidence against him. The prosecutor believes Michael acted in agreement with other family members and wants to charge him with both bribery and conspiracy to commit bribery.
