Overview

Criminal law extends liability beyond the person who physically commits a criminal act to those who assist, encourage, or facilitate the offense. Accomplice liability requires careful analysis of intent, participation, and the causal connection between a defendant’s actions and the resulting harm. These cases often raise difficult questions about moral blameworthiness versus legal responsibility.

In this activity, you will analyze a real-world inspired scenario involving encouragement of self-harm and evaluate whether accomplice liability applies. You will determine whether the actions described meet the legal requirements for accomplice liability and explain your reasoning. You will also identify what criminal charge, if any, would be most appropriate based on the readings. This exercise emphasizes close statutory reading, intent analysis, and the limits of criminal responsibility.

Discussion Topic(s)
In 2017 Michelle was texting her boyfriend Roy, who had been suffering from depression. On several occasions Roy mentioned that he wanted to kill himself. On July 12, 2014 Roy drove to a secluded parking lot. He kept his truck running and placed a garden hose from the tailpipe into a partially open window and then stepped into the truck. After a moment he stepped out of his truck and texted Michelle that he was considering backing out of his plan. Michelle told Roy to get back into the truck and complete his plan. The next morning Roy’s body was discovered having asphyxiated on carbon monoxide.
  • Should Michelle have been charged as an accomplice? Why, or why not?
