Overview

The insanity defense addresses situations in which a defendant’s mental state at the time of the offense may limit or eliminate criminal responsibility. Criminal law recognizes that punishment is not appropriate when an individual lacks the capacity to understand the nature of their actions or to distinguish right from wrong. Courts rely on specific legal standards to evaluate insanity claims, each reflecting different views of mental illness, culpability, and justice.

In this activity, you will analyze a real-world inspired scenario involving a defendant charged with multiple homicides while experiencing severe mental illness. Assuming the role of defense counsel, you will determine which type of insanity defense is most appropriate and explain why it best applies to the facts presented. This exercise emphasizes careful legal reasoning and reinforces how mental health considerations intersect with criminal responsibility.

On January 11, 2001 Miguel returned home from work to discover his five children had died. The cause of death was downing in the bathtub. His wife Johanny, who had been suffering from postpartum depression, was arrested and charged with the murder of her five children.

  • As her defense attorney, what type of insanity defense would you use?
