Overview

Criminal liability may be reduced or eliminated when a defendant can demonstrate that their actions were justified or excused under the law. Criminal defenses allow courts to evaluate whether conduct that would otherwise be criminal should be treated differently based on circumstances such as self defense, defense of others, or necessity. These defenses balance individual rights with public safety and are especially important in cases involving the use of force.

In this activity, you will analyze a hypothetical scenario involving a homeowner who used force against an intruder and is now facing criminal charges. You will assume the role of defense counsel and determine which criminal defense may apply based on the facts presented. By explaining and justifying your chosen defense, you will practice applying legal principles to realistic situations and evaluating how defenses operate within the criminal justice system.

Discussion Topic(s)

An intruder broke into Gregory Mason’s home at 3:00 am on March 15, 2020, with the intent to steal his expensive and rare coin collection. Asleep upstairs when he heard the noises in the middle of the night, Gregory, armed with a baseball bat, proceeded to beat the intruder nearly to death. He was charged with the crime of aggravated battery and is awaiting trial. Gregory is considering what options, if any, he has as a defense to the crime.

  • If you are Gregory’s defense lawyer, what type of defense would you suggest and why?

  • Use AI to review common criminal defenses related to the use of force, such as self defense or defense of property, to support your understanding before writing your response.
  • Use AI to explore factors courts consider when evaluating criminal defenses, such as proportionality and reasonableness, without using AI to write your discussion post.
