Overview

Criminal law is constrained by constitutional principles that limit how far the government may go in defining and enforcing criminal behavior. These limits exist to protect individual rights and ensure that criminal statutes are fair, clearly defined, and consistently applied. Laws that regulate areas such as obscenity, loitering, and vagrancy are often closely examined by courts because they can implicate fundamental constitutional protections.

In this activity, you will identify the constitutional limit that most often applies to obscenity laws and laws addressing loitering and vagrancy. You will define the selected constitutional limit and explain why it is particularly relevant to these types of statutes. This exercise reinforces your understanding of how constitutional safeguards shape criminal law and prevent overly broad or vague laws from infringing on individual liberties.
