Overview

Criminal law includes offenses designed to protect government institutions, public order, and the lawful functioning of democratic processes. These crimes focus on conduct that interferes with government operations, trespasses into restricted spaces, or disrupts public institutions. Courts evaluate such cases by examining statutory elements, intent, and the nature of the prohibited conduct.

In this activity, you will analyze a real world inspired scenario involving unlawful entry and disruption of a government facility. Using only the readings for this module, you will determine which criminal charges are supported by the facts and which are not. This exercise emphasizes objective legal analysis, careful statutory application, and the distinction between criminal conduct and protected expression.

Discussion Topic(s)
On January 6, 2021, a large group of individuals gathered in Washington, D.C. to protest the results of the 2020 Presidential Election. During the protest, some individuals approached security barriers surrounding the U.S. Capitol, breached those barriers, and entered the Capitol building. While inside, individuals chanted slogans, entered the U.S. Senate chamber, and accessed various congressional offices.
Applying only the legal principles and statutes discussed in this week’s readings, and avoiding political arguments or opinions, answer the following:
  1. Identify and explain the criminal offenses that could be charged based on the conduct described.
  2. Explain why the elements of each identified offense are satisfied by the facts provided.
  3. Identify crimes discussed in this week’s readings that you would not charge in this scenario and explain why the elements are not met.
Your analysis should focus strictly on criminal law doctrine, statutory elements, and conduct, not political beliefs or motivations.

  • Use AI to summarize the legal elements of crimes involving unlawful entry, disorderly conduct, or interference with government functions to support your understanding before writing your response.
