Overview

Burglary is a property crime that centers on unlawful entry combined with criminal intent. Unlike theft offenses, burglary focuses on the invasion of protected spaces and the heightened risk posed to occupants. Criminal law distinguishes between degrees of burglary based on factors such as how entry occurs, whether the structure is occupied, and the potential danger to persons inside.

In this activity, you will examine how burglary is defined and classified by analyzing different methods of entry and statutory requirements. By explaining doctrinal concepts and applying them through examples, you will develop a clearer understanding of how burglary offenses are structured and why certain circumstances result in more serious criminal charges.

Discussion Topic(s)
Burglary offenses are defined not only by unlawful entry, but also by the method of entry, the intent of the defendant, and the nature of the structure involved. Courts carefully distinguish between different types and degrees of burglary based on how entry occurs and what legal interests are being protected.
In your response:
  1. Define burglary and explain how it differs from related property crimes.
  2. Describe the different degrees of burglary and how methods of entry affect the severity of the offense.
  3. Explain the following concepts and how each can satisfy the entry requirement of burglary:
    • Constructive entry
    • Entry by fraud
    • Trespassory entry
    • Occupied dwelling requirement
  4. Provide at least one example that demonstrates how a burglary charge could be elevated based on the method of entry or the type of structure involved.
