Module 11 Discussion Activity

Review the discussion overview, learning objectives, prompt, and participation expectations before posting.

Overview

Criminal law places heightened protection on individuals who are vulnerable due to age, coercion, or the use of force. Crimes involving sexual conduct, stalking, and abduction require careful analysis of consent, intent, and statutory protections, particularly when a victim is a minor. Courts evaluate these cases by examining the timeline of events and the defendant’s conduct at each stage.

In this activity, you will analyze a detailed factual scenario involving deception, sexual conduct, escalating control, and forcible restraint. You will identify the criminal offenses that may have occurred and explain how the victim’s age and the defendant’s actions affect criminal liability. This exercise emphasizes element based reasoning and reinforces how multiple crimes can arise from a single course of conduct.

Learning Objectives

(These are not the questions to be answered. Please review and answer the Discussion Topic(s).)

  • LO1: Identify and explain criminal offenses involving sexual conduct, stalking, and abduction by applying statutory elements to a factual scenario. (SLO1)
  • LO2: Analyze how age, consent, and use of force impact criminal liability in crimes against the person. (SLO2)
Discussion Topic(s)
On September 2, 2019, Femi received a text message from a girl named Amara, who stated that she obtained his phone number from a friend. During their initial conversation, Femi asked Amara how old she was. She responded that she was 22 years old, although she was actually 13. Over the next several weeks, Femi and Amara communicated regularly through text messages and phone calls. Eventually, Femi drove to Amara’s home, where she explained that her parents were temporarily living with her due to fire damage at their residence.
After their second date, Femi and Amara engaged in what Femi believed to be consensual sexual activity in his vehicle. A few days later, Amara told Femi that she no longer wished to continue the relationship. Believing that Amara was seeing someone else, Femi became enraged and began following her over the next several weeks. On October 13, 2019, Femi located Amara walking alone near her home. He forced her into his vehicle and drove her to a location he had previously wanted to show her.
Based on the facts provided:
  1. Identify and explain each criminal offense Femi may have committed, citing the relevant legal elements for each charge.
  2. Discuss how Amara’s age affects criminal liability, even if Femi believed she was an adult.
  3. Explain whether Amara’s apparent consent at any point impacts the criminal charges and why or why not.
  4. Distinguish between the offenses related to sexual conduct, stalking, and abduction or kidnapping based on the timeline of events.
Acceptable and Ethical Use of AI
  • Use AI to review the legal elements of crimes involving statutory sexual offenses, stalking, and kidnapping or abduction to support your understanding before writing your response.
  • Use AI to clarify how consent and mistake of age are treated under criminal law, without using AI to write your discussion post.
Directions

Please read all instructions carefully before participating in the discussion.

  • Students must complete one Main Post that answers the discussion topic using more than 250 words.
  • Students must reply to at least two of their classmates (Peer Responses) using at least 150 words. Responses should encourage further dialogue in the discussion forum. Asking a classmate, a question is a nice way of furthering that dialogue.
  • Students must first compose an original Main Post to gain access to the discussion forum. Attempts to post a blank initial post or anything other than the true Main post will result in a 20-point deduction.
Important Reminder

Important: Submitting incomplete or placeholder responses may result in a grade deduction based on course policies.
