Overview

Criminal homicide offenses are distinguished by intent, circumstances, and the status of the victim. Prosecutors must evaluate not only the act of killing, but also the defendant’s state of mind, the presence of aggravating factors, and any statutory enhancements that apply. Cases involving law enforcement victims raise additional legal considerations that can significantly affect charging decisions and potential penalties.

In this activity, you will analyze a complex factual scenario involving domestic violence, ambush, and the killing of police officers. Taking the role of prosecutor, you will determine the most appropriate criminal charge based on the facts presented and explain your reasoning. You will also consider whether additional charges or enhancements may apply, reinforcing your understanding of how criminal homicide laws are applied in practice.

Discussion Topic(s)
Maria, a victim of ongoing domestic violence, threatens to call the police if her partner, Alexis, batters her again. Alexis dares Maria to call the police. When Maria makes the call, Alexis runs out of the house. While outside Alexis waits behind bushes for the police to arrive. When the police cruiser pulls in the driveway and both officers exit the vehicle Alexis opens fire on the officers killing both officers. Later that evening Alexis is arrested.
