Overview
This assignment is designed to help you understand two foundational concepts of the American legal system: the burden of proof and the dual court system. You will examine how civil and criminal cases differ in the level of evidence required to reach a verdict and explore why these different standards are necessary to promote fairness and justice. By analyzing both a civil and a criminal court case, you will see how burdens of proof influence legal outcomes and shape judicial decision-making.
In addition, you will explore the structure of the dual court system by examining the relationship between federal and state courts. Understanding how these court systems coexist and share authority is essential for understanding how legal disputes are processed in the United States. Through this activity, you will apply legal concepts to real cases, evaluate the effectiveness of current legal standards, and develop a deeper understanding of the American judicial system.

Assignment Topic
The American legal system distinguishes between civil and criminal law, particularly in how cases are tried and decided. For this assignment, you will examine how the burden of proof differs between civil and criminal cases and why those differences matter.
In your paper, address the following:
- Explain the burden of proof in both criminal and civil cases, including:
- The standard required in criminal cases
- The standard required in civil cases
- Why the legal system applies different standards depending on the type of case
- Analyze two specific court cases—one civil and one criminal—that illustrate these differences:
- Identify the case, court, and general facts
- Summarize how the burden of proof was applied
- Explain how the outcome may have differed if the burden of proof were higher or lower
- Explain the concept of the Dual Court System:
- Define what is meant by the dual court system
- Describe how federal and state courts coexist and share authority
- Explain why understanding the dual court system is important when analyzing civil and criminal cases
- Conclude with a brief reflection:
- Do you believe the current burdens of proof are appropriate for civil and criminal cases?
