Overview

This activity is designed to strengthen your understanding of criminal defenses and how they function within the judicial system. By identifying and explaining multiple defenses, you will move beyond simple definitions to examine when and why these defenses are used in real legal contexts. Through the use of real or hypothetical examples, you will apply legal concepts to practical situations and demonstrate how defenses operate in criminal cases. The assignment also encourages comparison and evaluation of different defenses, helping you better understand their limitations, public perception, and impact on prosecution. The goal is to develop analytical writing skills while deepening your knowledge of criminal law principles.

  • LO1: Identify the various defenses used to answer against changes of criminal misconduct. (SLOLO3) 
  • LO2: Explain how crimes are classified and defined according to the Model Penal Code. (SLO2)
Assignment Topic

There are ten commonly recognized legal defenses within the American criminal justice system. For this assignment, identify eight (8) criminal defenses and explain how each functions within the judicial process.

For each defense, you must:

  • Define the defense in your own words
  • Explain when and why the defense is used in criminal cases
  • Provide an example illustrating the defense in practice Examples may be drawn from a real criminal case reported in the media or a clearly identified fictional scenario

After addressing the eight defenses individually, include a short comparative analysis addressing the following:

  • Which defenses rely most heavily on intent and mental state, and which rely on procedural or legal principles?
  • Which defenses do you believe are most commonly misunderstood by the public, and why?
  • In your opinion, which defense is most difficult for the prosecution to overcome? Explain your reasoning.
Acceptable and Ethical Use of AI
  • Use AI to help you organize and clarify the definitions and core principles of common criminal defenses discussed in the course so you can plan your paper before writing.
  • Use AI to assist you in thinking through how different criminal defenses operate in practice and how they compare in terms of intent, burden of proof, and public understanding, helping you structure your analysis before completing the assignment.

  • Your paper should be 2-3 pages, using APA style, including 12 font and 1-inch margins.
  • A minimum of at least two (2) sources, with proper APA citations in a Reference Page and proper in-text citations.
  • Abstract NOT needed.
